Where Things Stand With the New Hemp Law
If you’ve seen the headlines about “the new hemp law” and felt confused, you’re not alone. A huge federal bill just moved through Congress and, tucked inside all the government funding language, were major changes that directly target hemp-derived psychoactive products – things like THCA flower and delta-8-style products.
At Green Nursery, we’ve been here since the early days of hemp. We’ve seen the industry change a lot, and this is one of the biggest shifts yet. We want to explain what happened in clear, simple terms, share how it affects us and you, and let you know that whatever the final rules end up being, our priority is staying compliant and staying open so we can keep serving our long-standing customers.
How the Original Hemp “Loophole” Happened
Back in 2018, Congress legalized hemp at the federal level. The key line in that law said:
Hemp is cannabis with no more than 0.3% delta-9 THC by dry weight.
That one sentence is where the “loophole” came from:
- It only mentioned delta-9 THC. It didn’t say anything about other forms of THC like delta-8, delta-10, or THC-P.
- It measured THC in the raw plant, not after heating. THCA turns into delta-9 THC when heated (like when you smoke or vape), but the law focused on the numbers before that conversion.
So what happened?
- Processors figured out how to turn CBD from hemp into other psychoactive cannabinoids (like delta-8).
- THCA flower could test under 0.3% delta-9 before heating, but become much stronger once smoked.
Because the law was written narrowly, these products technically fit inside the federal definition of “hemp,” even if they could clearly get people high. That’s the basic “loophole” that made psychoactive hemp products widely available, while still being legally distinct from state-regulated marijuana.
What Congress Just Did in the New Omnibus Bill
Fast-forward to now. Instead of passing a clean, stand-alone hemp bill, Congress tucked new hemp language into a giant omnibus funding package – the kind of mega-bill that keeps the government open and runs hundreds of pages deep.
In very simple terms, the new hemp language aims to:
- Close the “intoxicating hemp” gap. The goal is to treat hemp products that can reasonably get you high more like marijuana, regardless of whether it’s delta-9, THCA, or another form of THC.
- Crack down on loophole products. That includes things like high-THCA flower and heavily psychoactive hemp gummies that have been living in the gray area.
But there’s a twist: the law also includes a one-year moratorium period. That means there’s roughly a year-long window where the new rules are not fully enforced in the harshest possible way, while regulators and lawmakers sort out the details.
In practice, that one-year moratorium is both:
- A warning shot to our industry that the old loopholes are not going to last forever, and
- A chance for businesses, advocates, and everyday customers to push for a more balanced, realistic approach instead of an outright wipeout of hemp products you’ve come to rely on.
Our Feelings About How This Was Done
We’re going to be honest: we have great displeasure with how this played out politically. Instead of a transparent, stand-alone debate on hemp, it was slipped into a giant omnibus bill—classic D.C. maneuvering where big policy changes ride along with “must-pass” government funding.
And yes, we also have to say it plainly: our frustration with figures like Mitch McConnell runs deep. The same leadership that helped set up the original hemp framework now seems perfectly comfortable letting our industry get whiplash from sudden crackdowns. We are very much looking forward to the day he steps down and makes room for people who actually understand what small hemp businesses and their customers are going through on the ground.
What This Means for Green Nursery Customers Right Now

- We are staying compliant. Whatever the rules are, and however they evolve, we will follow them. That’s how we stay open and able to serve you.
- Some products may change. Product categories like THCA flower or more psychoactive hemp gummies may have to be reformulated, relabeled, or phased out over time depending on how federal and state rules are enforced.

You might see us adjusting our lineup, tightening up lab standards even further, or leaning more heavily into non-intoxicating options like traditional CBD flower, CBD gummies, and wellness-focused products. Our promise is that we will always be upfront about what’s changing and why.
The One-Year Window: Why We’re Still Hopeful
That one-year moratorium isn’t just a throwaway line in the bill. It’s time. Time for:
- Negotiating a middle ground. There’s a huge difference between responsible, lab-tested hemp products from specialized shops and sketchy, unlabeled items sold anywhere and everywhere.
- Educating lawmakers. Many in Congress still don’t understand the difference between hemp, marijuana, THCA, and cannabinoids in general. This year is a critical period to push for regulations that make sense instead of blanket overreactions.
- Refining the rules. A realistic framework might include things like potency caps, age limits, packaging standards, and strong testing requirements—without erasing the entire hemp marketplace that millions of people rely on.
We believe there is a path where:
- Adults can access vetted, lab-tested hemp products,
- Bad actors get pushed out of the market, and
- Small, transparent businesses like ours aren’t crushed because of how the last few years of loopholes were abused.
