Can You Buy CBD at 18? Age Rules for Online Orders
Last updated:
Being 18 does not automatically qualify you to buy CBD online. The answer depends on the applicable laws, the exact product, and the seller's purchase requirements. Some rules cover broad categories of hemp products; others distinguish between flower, concentrates, and products with particular THC levels.
If you are asking how old you have to be to buy CBD, start with those requirements before treating a blocked checkout as a technical problem. For the broader explanation of verification requests, privacy, and legitimate support options, read our guide to age verification at online checkout.
How old do you have to be to buy CBD?
A useful answer must identify the product and jurisdiction. A general statement that “CBD is legal” leaves out the rules governing its manufacture, sale, and purchase.
The USDA's hemp framework concerns production. USDA also explains that states and Tribal governments can impose additional requirements on manufacturing and retail. A crop's status under that framework does not, by itself, answer whether a particular retail order is allowed.
Federal product rules still matter
FDA requirements apply separately from hemp's controlled-substance classification. For example, the FDA's cannabis and CBD guidance states that adding CBD to food introduced into interstate commerce is prohibited under the applicable federal provision. Meeting an age threshold does not resolve that separate issue.
This is why a website listing, a payment option, or a “federally legal hemp” statement should not be treated as a complete legal assessment of an order.
Check the date on legal explanations
Federal hemp rules are also changing. As checked on November 5, 2026, the Minnesota Office of Cannabis Management's federal update identifies December 11, 2026 as the revised effective date for the federal hemp definition change, unless further federal action occurs. Older summaries may still show November 12. This concerns product classification and does not establish that an 18-year-old can purchase a product.
Examples of hemp rules that require age 21
These examples show why an across-the-board “18+” answer can be misleading. They describe specific restrictions, not every condition for a lawful sale. They are not a complete state-by-state guide.
| Jurisdiction | What the official source says | What it means at 18 |
|---|---|---|
| Florida | Section 581.217(7)(d), Florida Statutes, prohibits sales to people under 21 of products containing hemp extract that are intended for ingestion or inhalation. | The restriction is not limited to products advertised as intoxicating. An 18-year-old does not meet the age requirement for the covered products. |
| New York | New York's cannabinoid hemp guidance requires age 21 for flower products, concentrated cannabinoid hemp products, and cannabinoid hemp products containing more than 0.5 milligrams of total THC per serving. Its guidance expressly includes online sales to New York consumers. | Calling a covered product “CBD flower” does not remove the age requirement. |
| Texas | The Texas DSHS consumable hemp FAQ says sellers must verify that purchasers of consumable hemp products are at least 21 using valid government-issued identification before completing a sale. | The published requirement covers consumable hemp products, including smokable hemp. It is not an 18+ purchasing rule. |
If your state is absent from this table, that does not establish permission to buy. Consult its current regulator guidance and applicable law for the particular product. Rules about sale, possession, and use can address different conduct; this article focuses on purchase eligibility.
Why the exact hemp product matters
“Hemp product” is a broad description. The New York rules above illustrate how product form and total THC per serving can affect an age requirement. Florida's rule illustrates a different distinction: whether a hemp-extract product is intended for ingestion or inhalation.
When trying to understand a restriction, identify:
- The cannabinoids: whether the label lists CBD alone, CBD with THC, THCA, delta-8 THC, or another combination.
- The format: flower, a concentrated extract, an ingestible product, or a topical product.
- The labeled amounts: concentrations and amounts per serving or container, where relevant to the rule.
- The destination: the jurisdiction where the order would be delivered.
Do not transfer an answer about one product to another simply because both are hemp-derived. A rule about CBD flower does not necessarily answer a question about a cream, and a rule about one cannabinoid does not establish the status of another.
A certificate of analysis, or COA, can help explain the reported contents of a batch. Our guide to third-party testing for CBD and hemp explains that document. A lab report does not establish the customer's age or override a purchase restriction.
Why checkout may still block an order
An age check can involve both the retailer's chosen requirements and the information used to confirm your identity. Those are different questions.
For example, AgeChecker.Net explains that merchants set their age requirements and that the verification service cannot override those settings. Its documentation also describes requesting identification when an automatic check cannot confirm a customer's age. This is an example of one provider's process, not a claim about every store.
At 18, a check that correctly enforces a 21+ requirement is not an error. If you meet all applicable requirements and the system cannot verify you, the next step is the merchant's approved support process.
What Green Nursery's published policies say
Green Nursery's terms and conditions refer to being at least 21 or meeting the minimum age required by applicable law in the customer's jurisdiction. The terms also reserve the right to refuse or cancel restricted orders. That wording should not be read as a blanket promise that every 18-year-old qualifies.
For a specific policy question, ask Green Nursery to clarify the requirement for the product and destination. The shipping policy separately describes product and destination restrictions. An available shipping option does not establish that the buyer meets every requirement.
What to do when the requirement is unclear
- Read the actual message. Does it state a minimum age, report an identity-verification failure, or describe a delivery restriction?
- Identify the applicable rule. Use the current state regulator or statutory source for the product category. Do not rely on an undated age chart.
- Ask the merchant to clarify its policy. Provide the product name, your state, and the wording of the message. Keep identification documents out of an initial general inquiry.
- Use official review only when eligible. If you meet the requirements, ask which correction or secure verification process the merchant provides. If the required age is higher than yours, do not continue the restricted purchase.
A useful support question is: “I'm 18 and trying to understand your policy for this product in my state. Does this message reflect a minimum-age requirement, a destination restriction, or a verification error?”
For a Green Nursery order, contact customer support for a policy clarification. A support reply can explain the store's process; it does not replace applicable law.
Purchase eligibility and health are separate questions
Meeting an age requirement does not establish that CBD is appropriate for you. The FDA's consumer guidance on CBD identifies potential risks, including liver injury and interactions with medicines, and recommends discussing use with a healthcare provider.
If your interest in CBD relates to symptoms or a health condition, talk with a qualified clinician. A retailer's checkout process cannot assess your medical history or establish a treatment plan.
Frequently asked questions
Can I buy CBD online at 18?
Being 18 alone is not enough to answer. You must meet the applicable product and location rules as well as the retailer's requirements. The official examples above include categories restricted to purchasers who are at least 21.
Is the CBD buying age always 18 or always 21?
Neither number is a reliable nationwide answer for every product. State rules can distinguish among product categories, and store policies add another requirement. A claim about a particular seller should not be presented as the law everywhere.
Does a THC-free label mean there is no age restriction?
No. An age rule may cover a category of hemp products rather than only products above a THC threshold. Florida's ingestion and inhalation restriction and Texas's consumable hemp guidance illustrate why a THC claim alone does not establish eligibility.
Can I buy CBD flower at 18?
Do not assume flower follows the same rules as every other CBD format. New York's cited guidance explicitly limits cannabinoid hemp flower sales to people 21 and older. Elsewhere, check the applicable flower rules and the seller's policy.
Does showing my ID make an 18-year-old eligible?
Identification can establish your age; it does not change the required age. An ID showing that you are 18 cannot satisfy a 21+ requirement. If the age is correct but another detail cannot be verified, ask about official review only if you otherwise qualify.
What if my payment went through before verification stopped the order?
Ask the merchant whether the order is pending, canceled, or awaiting review, and whether the payment is an authorization or a completed charge. Do not treat a payment confirmation as proof of eligibility or assume a refund has already been issued.
Is prescription CBD the same as an online CBD product?
No. The FDA identifies Epidiolex as an approved prescription CBD medicine for specific seizure disorders. Its approval does not extend to ordinary retail CBD products or grant general permission to purchase them.
Does this article establish whether possession or use is legal?
No. It explains selected purchase requirements. A rule restricting sales to someone under 21 does not, by itself, answer every question about possession, use, or enforcement. Those questions require the relevant law and facts.
